PREAMBLE


The company KYDJU carrying out its activity under the name of the ARTHOD brand is a company under French law registered in the Bourges trade and companies register under the number Siret 823 472 444 and whose head office is located at 2D route de la Couturanderie 18330 SAINT-LAURENT (France) represented by MME Sylvie SAVATDY acting and having the necessary powers as president. Our VAT number is FR 048 23472 444. CE standard EN ISO 12312-1:2022
The purpose of these General Conditions of Sale and Guarantees (hereinafter “CGV”) is to define the conditions and terms in which the company KYDJU offers the marketing of its ARTHOD brand products and services to its customers. These conditions establish the rights and obligations of any user (hereinafter, “Client”, “you”, “Individual Client”, “Professional Client”) and of KYDJU (hereinafter, “we”, “ARTHOD”, “ our"), in relation to the goods we offer through this website.
Consequently, any order from the customer implies its unreserved acceptance and full acceptance of these General Terms and Conditions which take precedence over any other document, except for special conditions expressly granted in writing by KYDJU concerning the ARTHOD brand.


The customer acknowledges having read the General Terms and Conditions prior to his order. These General Conditions of Sale come into force on June 16, 2023.
We keep a copy of the contract concluded between us (these General Conditions of Sale) and we recommend that you print a copy of these for all purposes. .
KYDJU reserves the right to modify these T&Cs concerning the ARTHOD brand at any time by publishing a new version on the Site (site address). In the event of modification of the General Conditions of Sale, the applicable General Conditions of Sale are those in force on the date of the order, a copy of which will be given to the customer along with the order confirmation letter.
The invalidity of a clause of these General Conditions of Sale does not entail the nullity of the entire General Conditions of Sale.The temporary or permanent non-application of one or more of these clauses of the T&Cs by KYDJU for the ARTHOD brand cannot constitute a waiver on its part of the other clauses of the T&Cs which continue to apply and produce their effects.
The photographs on the Site do not constitute a contractual document.
Prior to placing an order, the Customer certifies:
- being a legally capable natural person aged at least eighteen (18 ) years ; and/or
- be a legally capable legal entity with a SIRET number and a valid VAT number;
- be the holder or duly authorized to use the payment card used to pay the total order amount; it being specified that said payment card gives access to sufficient funds to cover the total amount of the order.
The products offered for sale, published on the site, are each the subject of a description mentioning their essential characteristics within the meaning of article L.111-1 of the Consumer Code and a User Guide (hyperlink to PDF format).

ARTICLE 1 – DEFINITION


- Customer: Refers to any User who is a natural and/or legal person (hereinafter “Individual Customer” and/or “Professional Customer” of the store who has purchased a Product from the ARTHOD brand.
- Personal Account: Refers to the account available to any Customer to manage and place orders in order to access the services, including the personal data necessary for KYDJU to provide the products provided for herein.
- Order: Refers to the process consisting for the Customer of the selection of the products he wishes to purchase and receive and the purchase of the latter.
- Contract: Refers to these General Terms and Conditions and any special conditions applicable to certain operations Therefore, the Customer waives the right to rely on any contradictory document which would oppose the Contract and which would therefore be unenforceable against KYDJU.
- Personal data:Refers to all information relating to the Customer who is a natural person (hereinafter “Individual” and the Customer who is a legal entity (hereinafter: “Professionals”), “Distributor”) provided by him during the Order or the creation of a Personal Account.
- Parties: Jointly designates KYDJU SASU creator and exclusive owner of the registered trademark ARTHOD (Figurative Trademark Number: 4938171 / Word Trademark Number: 4938162) and the Users of the Site.
- Products or Goods: Refers to the store's products and Goods available for sale on the Site.
- Services: Refers to the online sale of Products through the Site but also the distribution of Products subscribed to by the Customer.
- User: Refers to any natural and/or legal person accessing the Site whether they are a Client or not.

ARTICLE 2 – DEFINITION OF THE PROPOSED SERVICE


KYDJU's activity is:
- The creation, design, production and manufacturing of glasses, eyewear items (optical glasses, sunglasses, fashionable glasses, 3D glasses, glasses cases, glasses parts , spectacle frames, spectacle chamois, accessories, packaging)
- Online or offline retail or wholesale service for glasses, eyewear items
KYDJU is the publisher and operator of the “ARTHOD” website ( www.arthod.com) whose purpose is the retail or wholesale sale of glasses and eyewear articles for Individuals and Professionals.

ARTICLE 3 - ACCESS TO THE

SERVICE

The Services of the ARTHOD by KYDJU Site are normally accessible by the Customer 24 hours a day, 7 days a week and all year round except in the event of voluntary or unintentional interruption, regardless of the cause. This could include maintenance. Being, through its activity, subject to an obligation of means, the company KYDJU cannot be held responsible for any physical, material or moral damage caused by the unavailability of the site(s).
To validate your order and purchase Products offered on and through the Site, you must register on the Site and thus create your Personal Account involving the use of an identifier and a password, at the Customer's own risk. . The chosen password is personal and confidential. It is up to the Customer to take all necessary measures to protect this data. KYDJU, for its part, undertakes to put in place all the means at its disposal to guarantee the security and confidentiality of the data thus transmitted.
The personal data provided by the Customer are necessary for processing the order and establishing invoices.
- The customer agrees that they will be communicated to KYDJU partners responsible for execution, processing , management and payment of orders.
- KYDJU implements appropriate technical measures to guarantee a level of security adapted to the risk of harm to the security, integrity and confidentiality of data .
- KYDJU keeps the data for the strict period necessary for the execution of the contract.
- The processing of information communicated via the website (site address) has been subject to a declaration to the CNIL.
- The Customer has a permanent right of access, and a right of modification, rectification and opposition with regard to information concerning him.
When registering online, the Customer undertakes to provide accurate, up-to-date and complete information about their identity and which does not infringe the rights of third parties. In particular, he undertakes not to use a false or usurped identity likely to mislead KYDJU or third parties. Failing this, KYDJU reserves the right to immediately suspend, without notice or compensation, their Personal Account or to refuse access to it temporarily or permanently. The Customer is required to provide a valid electronic (e-mail) address and to update his personal data.
Only one Personal Account can be created per Customer.


3.1 Creation of Professional Customer account KYDJU offers a service adapted to traders and all people carrying out an independent professional activity (intended for resale).
When registering online, the Professional Customer must prove the existence of his business assets and/or his professional status by producing a Kbis extract, an extract from the trade register less than 3 months old or any other document proof of valid professional activity. The following information: SIRET number and VAT number will be requested upon registration in order to create the Professional Customer account. KYDJU grants itself the right to refuse any customer whose APE code is not closely linked to the resale of products. As long as the Customer has not provided KYDJU with all the supporting documents necessary for the allocation of his account, KYDJU will not validate this access and an incident will be entered on the Customer's account: "account awaiting payment". validation”, incident which will be updated as soon as the situation is regularized by the Customer. When an item is missing, an email will be sent to you (check your spam). Validation of an account is not automatic. It can be validated within 48 hours. The Customer undertakes to exclusively make purchases for resale, directly related to his main professional activity (specified by his APE code). Persons carrying out an activity which cannot be defined as a commercial act or a craft activity intended for re-sale cannot obtain a KYDJU purchasing account. KYDJU reserves the right to refuse the allocation of a KYDJU purchasing account to any person or employee who has left an unpaid bill or any other unresolved dispute in the context of a past or current activity.
3.2. ARTHOD Agent Service for the Professional Customer
KYDJU Agents can be reached to make an appointment by e-mail or by telephone.


ARTICLE 4 - SERVICE FEATURES – PRODUCT CONFORMITY & AVAILABILITY


KYDJU may modify at any time the assortment of products and services offered for sale on its Website, without prejudice to Orders placed by the Customer.
The Customer can, prior to his commitment or his Order, read, on the ARTHOD by KYDJU Website, the essential characteristics of the services and/or product(s) he wishes to order. See the User Guide

The Client admits and acknowledges. In any case,we encourage you to read all information on the labels, warnings and instructions accompanying the Goods before using them.
The offers presented by KYDJU are valid as long as they are announced on the Site and within the limit available stocks. In the event of unavailability of one or more products or services after placing the Order, the Customer will be notified by e-mail. If the product for the current month is out of stock, KYDJU undertakes to find a solution to satisfy you as best as possible: sending a special product, sending the product for the following month, etc. In this case KYDJU cannot be held responsible for any damage suffered by the Client, nor liable for any damages.


ARTICLE 5 - ORDER & DELIVERY OF GOODS


When the Customer confirms his order by clicking on the validation button provided for this purpose, he is considered to have knowingly accepted the content and conditions of the Order in question and in particular these General Conditions of Sale, prices, volumes, characteristics, quantities and delivery times of the products offered for sale and ordered by the Customer.
KYDJU reserves the right to suspend or cancel any execution of an Order and/or delivery, whatever its nature and level of execution, in the event of non-payment or partial payment of any sum due by the Customer, in the event of a payment incident, or in the event of fraud or attempted of fraud relating to the use of the KYDJU Website, including in connection with previous Orders. Also, in the event of an error in entering the email address concerned, or non-receipt of the email Order confirmation message, KYDJU cannot be held liable. In this case the sale will be considered final, excluding cases of cancellation of the Order by KYDJU, in particular due to unavailability of the products.
Similarly, if an order sent by KYDJU to a Customer was returned (invalid email address , postal address not found, return of the lot by post with the mention “Does not live at the address indicated”, false declaration, etc.), in the event of refusal of the package by the Customer, in the event of the customer's absence or in the event that the customer does not keep an appointment made with our delivery service, it will be deemed to have been delivered by KYDJU. KYDJU is not responsible if the Customer has provided an incorrect address or contact details for sending his product or if it has not been received within 10 days after first presentation by the delivery service for take possession of their item; in such a case it is understood that KYDJU will be deemed to have fulfilled its obligations concerning the obligation to deliver the product, it will therefore be deemed delivered.
5.1 Modification of order:
Once you have placed your Order, it cannot be modified, in particular with regard to the quantity of products ordered or the delivery address. This clause does not affect the rights that the law grants you for the purposes of withdrawal and/or return of goods for a purchase.
Products purchased on the KYDJU site will be delivered to the address indicated by the Customer on the site when placing their order, according to the delivery method chosen by KYDJU. The delivery times indicated on the site are indicative times, corresponding to the average processing and delivery times observed. KYDJU cannot be held responsible for the consequences due to a delay in delivery. In all cases, if the package is returned to the sender, a second delivery will be made at the Customer's expense. If the package is returned to the sender again, it will no longer be returned to the Customer and the amount corresponding to this order, including any additional delivery costs, will remain acquired by KYDJU.
5.2. Delivery times:
The delivery date of a Good is indicated during your Order as well as in your purchase summary. Failing to mention a precise delivery date, we will in any case deliver the Good(s) to you within a maximum period of 30 days from the conclusion of the contract.
5.3 Delay in delivery:
In the event of non-compliance with delivery times as provided for in clause 5.2 above, we thank you for reporting this to us as soon as possible by e-mail to the following address: following electronic:(contact@arthod.com) by giving us a reasonable additional period of time so that we can identify the cause of such a delay and provide an appropriate response. In any case, in the event of a delay in delivery not due to a case of force majeure and/or the carrier KYDJU cannot be held responsible.
5.4. Transfer of risk:
All risk of loss or damage to the Goods passes to you, at the time you (or a third party designated by you other than the carrier designated by us) takes physical possession of the Good.
5.5 Shipping and receiving:
Our products are shipped by the carrier of our choice offering a package tracking service. We take particular care in packaging and shipping our products. However, in the event of a problem upon arrival, we recommend opening the package in front of the driver and on the transport slip, making detailed reservations, specifying the broken or missing references and quantities. If there are too many packages, you must mark “To unpack uncontrollable goods, too many references”. Then send confirmation to the carrier within 48 hours, by copy of this letter (by e-mail, fax or mail). Without mail from the carrier, we may not be able to exchange missing or broken items free of charge. Only products presenting a manufacturing defect and returned within 48 hours in their original packaging will be returned or exchanged.
5.6 Packaging:
Products purchased from the Site Internet are delivered with standard ARTHOD packaging, (box containing the case and the microfiber wipe with the ARTHOD brand logo.).
5.7. Cases of Force Majeure:
KYDJU cannot be held responsible for any non-performance or delay in the execution of its contractual obligations, caused by events beyond our reasonable control (“Cases of Force Majeure” ). A Force Majeure Event includes any act, event, non-performance, omission or accident beyond our reasonable control and includes in particular (without limitation):
- Strikes, closures or other industrial actions.
- Civil unrest, riot, invasion, terrorist attack or threat of terrorist attack, war (declared or not) or threat or preparation for war.
- Fire, explosion, storm, flood,earthquake, subsidence, epidemic or other natural disasters.
- Inability to use transport by rail, boat, plane, road or other private or public means of transport.
- Inability to use public and private telecommunications networks.
- Acts, decrees, legislation, regulations or restrictions of any government.
- Strike, failure or accidents in maritime, postal or other transport.
Our performance relating to the Contract will be suspended for as long as the Force Majeure event lasts and our performance deadlines will be extended accordingly. We will endeavor to the extent possible to bring an end to the Force Majeure event or to find a solution enabling us to perform our contractual obligations despite the Force Majeure event.


ARTICLE 5 - ORDER & DELIVERY OF GOODS PROFESSIONAL CUSTOMER AND DISTRIBUTOR


All the terms and conditions prefigured above (Article 5: Order and delivery of goods) apply indiscriminately to both the Professional Customer, the Individual Customer and the Distributor.
However, minimum orders are set for Professional Customers and Distributors of the ARTHOD brand.
5.1. First order on the Professional Customer's Site:
Once the Professional Customer Account has been validated by our services, the Customer can place his first order.
The minimum number of pieces set for the first order is set at twenty-five (25) frames for cash payment.
KYDJU, allows its Customer to benefit from each first order paid with cash of a minimum of twenty-five (25) frames, an additional frame offered as well as free delivery costs (free shipping). Or 25 pairs of ARTHOD glasses purchased + 1 free ARTHOD by KYDJU.
5.2. Following orders from the Professional Customer:
For the following orders, KYDJU does not require a minimum order.
However, delivery costs will be offered to any Professional Customer placing an order greater than and/or equal to forty (40) frames.
5.3. Order from the Distributor Customer:
The minimum number of pieces set per order as well as the payment terms are set by contract between KYDJU and the Distributor. Please refer to it and if you have any questions, contact the Agent present in the Territory.


ARTICLE 6 – PRICES


The prices of the items offered on the Site are indicated in Euros (€).
The prices may be modified by KYDJU at any time and the modification will then be notified to the Customer by a specific display on the site. These changes will then apply to any new orders and will not affect orders for which we have already sent you a Dispatch Confirmation.
6.1. Individual Customer Prices
The price of any product is that stipulated on our site. The prices mentioned on our website include VAT (20%), however delivery costs are not included and will be added to the total amount due, in accordance with what is provided for in our Delivery Price Guide (hyperlink to Delivery Price Guide).
6.2. Professional Customer Prices
The price of any product is that stipulated on our site. The prices mentioned on our website are indicated excluding taxes (HT).
Applicable VAT and delivery costs are not included and will be added to the total amount due, in accordance with what is provided for under the terms of our Delivery Price Guide (hypertext link to Delivery Price Guide).
The Customer will be able to benefit from discounts, rebates on KYDJU prices, depending on the quantities acquired or delivered, in one go, and in one place , or the regularity of its orders. The terms and conditions for granting rebates, discounts, sponsorships and “goodies” will be indicated and updated regularly on the Site.
6.3. Distributor Prices
The price of any product is that stipulated on our site as well as in the contract governing the distribution of the ARTHOD brand by the Distributor. The prices mentioned on our website are indicated excluding taxes (HT).
Applicable VAT and delivery costs are not included and will be added to the total amount due, in accordance with what is provided for under the terms of our Delivery Price Guide (hyperlink to Delivery Price Guide).


ARTICLE 7 – PAYMENTS


All orders are payable in euros (€).
Payment for purchases is made using a bank payment card (Visa, Mastercard, Maestro, CB, American Express, PayPal, Apple pay).
To minimize the risk of unauthorized access, your credit card data will be encrypted. Once your order is received, we will pre-authorize your credit card to ensure sufficient funds are available to complete the transaction. By clicking on “Buy now” you confirm that the credit card is yours. Credit cards are subject to validity checks and authorization by your card issuer but if that issuer does not authorize payment, we will not be responsible for the delay or non-delivery and we may not be able to contract with You.
The Customer guarantees to KYDJU that he is fully authorized to use the payment card for the payment of his order and that these means of payment legally give access to sufficient funds to cover all costs resulting from his order on the site ( name of the site). KYDJU cannot be held responsible for any fraudulent use of the means of payment used.
KYDJU reserves the right to suspend or cancel any order and/or delivery, whatever its nature and level of execution, in the event of non-payment of any sum due by the Customer or in the event of payment incident. It is up to the Customer to save and print their payment certificate if they wish to keep the banking details relating to their transaction.
An invoice will be sent by email for each order placed on the Site.
7.1. Payment for Individual Customers
For Individual Customers, cash payment when placing the order using the payment card offered by the site.
7.2. Payment for Professional Customers
The Professional Customer will have the choice of paying for their order in various ways:
- Cash payment upon ordering (compulsory when creating the Professional Customer Account and when placing the first order)
- Payment by 50% upon ordering then 50% 30 days from the date the product is shipped from the second order.
In accordance with article L. 441-10 of the Commercial Code, in the event of late payment of sums due by the Customer beyond the deadline set above, late payment penalties equivalent to 3 times the rate of Legal interests will be automatically and automatically acquired by KYDJU, without any formality or formal notice.
7.3.Distributor Payment
The conditions and terms of payment are set by contract between KYDJU and the Distributor. Please refer to it and if you have any questions, contact the Agent present in the Territory.


ARTICLE 8 – RIGHT OF WITHDRAWAL


8.1. Withdrawal periods:
In accordance with the provisions of article L.221-18 of the Consumer Code, your right of withdrawal is fourteen (14) days from the placing of the order. This withdrawal period expires fourteen (14) days after the day on which you, or a third party designated by you other than the carrier, takes physical possession of the Goods.
8.2. Withdrawal terms:
If you wish to withdraw, you must send us your decision to withdraw by any unambiguous declaration before the expiry of the withdrawal period, in particular by means of a letter with acknowledgment of receipt to the address of our head office.
8.3. Return of Goods:
Please note that if you exercise your right of withdrawal, you must return the Good(s) to us to the address indicated in your customer account, without delay excessive and no later than fourteen (14) days after you communicate your decision to withdraw to us. This deadline is deemed to be respected if you return the Good(s) to us before the expiry of the fourteen (14) day withdrawal period. The date of shipment of the products will be deemed to be authentic.
8.4. Returning the products:
You must take all necessary precautions to ensure that the Goods are properly packaged so that they are not damaged during transport. You must bear the costs relating to the return of the Goods.
8.5. Refund:
We will carefully examine the returned product and inform you of your right to a refund, if applicable. We will reimburse you as soon as possible and in any case, within 30 days from the day we receive the returned products. We will always refund any money we receive from you using the same payment method you originally used to pay for your purchase. Products that you return to us due to a defect will be refunded in full, if this defect is confirmed, including the costs you incurred in returning the product to us. We will always refund any money we receive from you using the same payment method you originally used to pay for your purchase. This is without prejudice to your legal rights.

ARTICLE 9 - SIGNATURE AND PROOF


KYDJU works to protect the personal information of its customers by ensuring a high level of security, but the Customer also has a role to play in protecting their personal data. In particular, the Customer must maintain the security of his online transactions, for example by not communicating his identifier (email address of the Customer) and/or his password to anyone and by regularly changing his password.
As such, KYDJU cannot be responsible for the disclosure of information concerning the Customer to any individual who has used his identifier (e-mail address of the Customer) and/or his password, except in cases of negligence or fault having contributed to allow this disclosure.
As such, any order made after entering the identifier (e-mail address of the Customer) and the password of the Customer will be presumed to have been made by the Customer and allow payment of the corresponding sums to be demanded, unless the Customer provides proof of misappropriation of his username and password by a third party. KYDJU cannot under any circumstances be held responsible for the fraudulent use of this information, except in the case of negligence or fault of KYDJU having contributed to allowing this fraudulent use.
The Client recognizes the validity and probative force of electronic exchanges and records kept by KYDJU and admits that these elements receive the same probative force as a handwritten signed document under Law No. 2000-230 of March 13, 2000 adapting the law of evidence to information technologies and relating to electronic signatures.


ARTICLE 10 - RESERVATION OF OWNERSHIP


KYDJU retains full ownership of the products sold until full payment of the full price, in principal, fees, taxes and mandatory contributions included.


ARTICLE 11 – LIABILITY


KYDJU remains responsible for the services that its staff perform.
KYDJU is liable for any lack of conformity of the goods sold in the event of a sale under provisions L211-1 and the Code of Consumption and hidden defects in the good under the conditions provided for in articles 1641 of the Civil Code.
The liability of KYDJU under the obligations of these General Conditions of Sale is an obligation of means and cannot be incurred in the case where the non-performance of its obligations would be attributable to the act of a third party even if it is foreseeable, to the fault of the Client, or to the occurrence of an event
of force majeure as defined by the French courts or any other event which was not reasonably under the exclusive control of KYDJU. KYDJU cannot be held liable for any damage caused to the Customer or a third party, and resulting from use not in accordance with the instructions for use of the product.
KYDJU DISCLAIMS ALL RESPONSIBILITY FOR DIRECT AND INDIRECT, WHETHER FORESEEABLE OR NOT, CAUSED DURING THE USE OF THE WEBSITE. IN THE HYPOTHESIS WHERE KYDJU'S LIABILITY SHOULD BE ESTABLISHED AND HELD DUE TO DAMAGE SUFFERED BY THE CUSTOMER AND ATTRIBUTABLE EXCLUSIVELY TO THE PLACING OF AN ORDER, THIS IS LIMITED TO THE AMOUNT OF THE ORDER PAID BY THE CUSTOMER A KYDJU.
Any complaint filed by a user, including any Customer, against KYDJU must be made within the month following the occurrence of the event, subject of the complaint.


ARTICLE 12 - DEACTIVATION OF THE CUSTOMER ACCOUNT


Non-compliance by the Customer with the obligations subscribed to under these General Conditions of Sale, any incident of payment of the price of an order, actions contrary to the interests of KYDJU, the delivery of false information when creating the account, may result in the suspension of access to the KYDJU service, or even the termination of the account depending on the degree of seriousness of the actions in question, without it being possible to claim any damages or compensation from the company KYDJU. KYDJU reserves the right to refuse any order from a Customer with whom there is such a dispute, even if the Customer uses a new account.


ARTICLE 13 - CUSTOMER SERVICE

ARTICLE 14 - SANCTIONS FOR NON-EXECUTION


In the event of non-compliance with the obligations arising from acceptance of these General Conditions of Sale, incidents of payment of the price of one or more transactions, provision of incorrect information when creating the account or acts likely to harm the interests of the Client or the KYDJU Company, KYDJU and the Client have the right, depending on the seriousness of the acts, to suspend or terminate the Client's account, without prejudice to any damages that may be claimed.


KYDJU also reserves the right to refuse to contract with a Client who has been sanctioned for such actions in compliance with regulations.


ARTICLE 15 - COMMUNICATION BETWEEN THE CUSTOMER AND KYDJU


By becoming a user of the website, the Customer acknowledges that exchanges between him and KYDJU will be mainly electronic (by e-mail) except in the special cases presented in these General Conditions or required by law. In particular, the Customer expressly accepts that invoices are sent to him by e-mail.
The Customer contractually acknowledges that the information, notifications and contracts are in full compliance with the regulations in force. It is understood between the parties that the choice of method of exchange constitutes an agreement on proof within the meaning of article 1316-2 of the Civil Code.


ARTICLE 16 - CONTINUITY AND TRANSFER OF RIGHTS AND OBLIGATIONS OF THE CONTRACT


The contracts between the Client and KYDJU and/or its successors and assigns are binding between the parties. Contracts, rights and obligations of Clients cannot be assigned or transferred without prior written consent. The contracts,KYDJU's rights and obligations may be assigned or transferred at any time without the Client's prior consent.


ARTICLE 17 - GENERAL


Non-waiver:
The fact of one of the Parties not claiming from the other Party a breach of any of the obligations referred to herein General Conditions of Sale cannot be interpreted for the future as a waiver of the obligation in question.
Applicable law and resolution of disputes Without prejudice to the mandatory provisions applicable for the benefit of consumers, the contract concluded between KYDJU and the Customer is subject to French law, the language of interpretation of the contract being the French language.
In the event of difficulty relating to the validity, interpretation and/or execution of this contract, the Customer may contact KYDJU by email to the following address: (contact@arthod.com).
In the event of failure to resolve the dispute between the parties, the parties may refer the matter to the competent court. The Customer can also contact the consumer mediator in advance. The Client may also contact any other consumer mediator having received approval from the Consumer Mediation Evaluation Commission for the sector of activity concerned. To contact a consumer mediator, the Customer must first contact KYDJU. In the absence of a response within two (2) months or in the event of an unsatisfactory response from KYDJU customer service, the Customer may, if he has not already seized a competent court and within a maximum period of one ( 1) one year following the date of sending the first notification to KYDJU, use the mediation service free of charge for consumer disputes arising from the execution of the contract concluded between KYDJU and the Customer. Disputes for which the request is manifestly unfounded or abusive or has previously been examined or is currently being examined by another mediator or by a court cannot be reviewed by the mediator.
What whatever the means used to contact the mediator, the Client's request must contain the following elements to be processed quickly: postal contact details of the Client, e-mail address and telephone number as well as the full name and address of KYDJU, a statement summary of the facts, and proof of prior steps taken with KYDJU.
ANY DIFFICULTY RELATING TO THE VALIDITY, INTERPRETATION OR EXECUTION OF THE CONTRACT BETWEEN THE CUSTOMER AND KYDJU WHICH COULD NOT HAVE BEEN THE SUBJECT OF AN AMICABLE AGREEMENT BETWEEN KYDJU AND THE USER FALLS WITHIN THE JURISDICTION OF THE COURTS DE BOURGES - FRANCE, WITHOUT PREJUDICE TO THE PROVISIONS APPLICABLE FOR THE BENEFIT OF CONSUMERS ALLOWING THEM TO SEIT THE COMPETENT COURTS OF THEIR PLACE OF RESIDENCE IN CERTAIN ASSUMPTIONS.


ARTICLE 18 – GUARANTEE OF AUTHENTICITY AND INTELLECTUAL PROPERTY


The content of the website, as well as all technical documents, products, drawings, photographs provided to Customers remain the exclusive property of KYDJU, the sole holder of the intellectual property rights over these documents.
You acknowledge and undertake to respect these rights and not to make any use of these documents which could infringe the industrial or intellectual property rights of KYDJU and you undertake not to disclose them to any third party.
18.1. KYDJU guarantees the authenticity of all Products purchased on the Website. Products bearing the ARTHOD trademark are products of French creation and design, produced rigorously and entirely MADE IN CHINA under the supervision of our Designer.
18.2. The “KYDJU” trademark, all figurative and/or three-dimensional trademarks appearing on the Products, accessories or relevant packaging, as well as all illustrations, images and places protected by copyright. The authors and, in general, all intellectual property rights linked to the Products, are and remain the exclusive property of the company KYDJU France.


ARTICLE 19 - APPLICABLE LAW AND LANGUAGE OF THE GENERAL CONDITIONS OF SALE


These general conditions of sale remain subject to French law and are written in French. In the event that they are translated into one or more foreign languages, only the French text will be authentic in the event of a dispute.


ARTICLE 20- GUARANTEE


ARTHOD brand products are guaranteed for one year, parts and labor,with replacement of the identical model (depending on available stocks or with a credit of the same value) under the express condition that the general conditions of use of the product have been strictly respected. This guarantee does not cover: breakage, theft, deliberate damage, normal wear and tear, scratches on lenses. If the “ARTHOD” product has a manufacturing defect, contact our customer service, specifying the defect in question.
